1. Acceptance of Terms
By downloading, installing, or using Nestly ("App"), you agree to these Terms of Service. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old to use Nestly. If you are under 18, you must have parental consent. By using the App, you confirm you meet these requirements.
3. Description of Service
Nestly is a mobile app for couples to stay connected through private messaging, mood sharing, a shared virtual pet, collaborative whiteboard, gift-giving, and iOS widgets. The App includes free and premium subscription features.
Important Disclaimer
Nestly is NOT a substitute for professional relationship counseling, therapy, or mental health services. The App is for entertainment and communication only. If you are experiencing relationship difficulties, mental health issues, or domestic abuse, please seek help from qualified professionals.
4. Your Account
You are responsible for maintaining the security of your account and for all activities under your account. Keep your login credentials confidential and notify us immediately of any unauthorized use.
5. Subscriptions and Payments
Nestly offers premium subscriptions with additional features. By subscribing:
- Payment is processed through Apple's App Store
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
- You can cancel anytime in your Apple ID account settings
- Refunds are handled by Apple - visit reportaproblem.apple.com
- Free trials convert to paid subscriptions unless cancelled before the trial ends
- Prices may change; changes apply at your next renewal
6. Virtual Currency and Gifts
The App includes virtual currency (Credits, Hearts) and virtual goods (Gifts, Pet Food). These have no real-world value, cannot be exchanged for money, are non-transferable, and may be modified or discontinued at any time without refund.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Harass, abuse, or harm others
- Upload illegal, harmful, or objectionable content
- Attempt to access other users' accounts or our systems without authorization
- Reverse engineer, copy, or modify the App
- Use the App for commercial purposes without permission
We may suspend or terminate accounts that violate these rules.
8. Your Content
You own the content you create (messages, photos, doodles). By using the App, you grant us a license to store, transmit, and display your content solely to provide the Service to you and your partner.
You are responsible for your content. Make sure it does not violate any laws, infringe on others' rights, or contain illegal, harmful, or objectionable material.
We reserve the right (but have no obligation) to review, remove, or disable access to any content at our discretion, without notice, for any reason - including content we believe violates these Terms. When your account is terminated, your content may be deleted and cannot be recovered.
We have no obligation to monitor, verify, or endorse any content shared between users. We are not responsible for the accuracy, legality, or appropriateness of any content created or shared by users. Any interactions or content exchanged between you and your partner are solely between you two, and we bear no responsibility for any disputes, harm, or consequences arising from such content or interactions.
9. Intellectual Property
Nestly and its content, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.
10. Privacy
Your privacy matters to us. Please review our Privacy Policy to understand how we collect and use your information.
11. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind. We do not guarantee the App will be uninterrupted, error-free, or meet your expectations. Use at your own risk.
We are not responsible for any loss of data, content, messages, photos, or other materials stored in the App, whether due to technical failures, account termination, service discontinuation, or any other reason. You are solely responsible for backing up any content you wish to preserve.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the 12 months before the claim, or $100, whichever is greater.
13. Termination
You may delete your account at any time through the App settings. We may suspend or terminate your access if you violate these Terms, or for any other reason at our discretion. Upon termination, your right to use the App ends immediately and any unused virtual currency or subscription time is forfeited.
14. Service Changes and Discontinuation
We may modify, suspend, or discontinue the App or any features at any time without notice. We are not liable for any changes to the Service.
If we permanently discontinue the Service, we will make reasonable efforts to notify you in advance. Upon discontinuation, all user content and data may be permanently deleted. We are not obligated to maintain, store, or provide copies of any content after the Service ends.
15. Governing Law
These Terms are governed by the laws of the Argentine Republic. Any disputes shall be resolved in the courts of Buenos Aires, Argentina. Nothing in these Terms affects your statutory consumer rights under applicable law.
16. Apple App Store Terms
If you downloaded the App from the Apple App Store:
- These Terms are between you and Nestly, not Apple
- Apple has no obligation to provide support or maintenance for the App
- Apple is not responsible for any claims related to the App
- Apple and its subsidiaries are third-party beneficiaries of these Terms
17. Changes to Terms
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. If you disagree with any changes, stop using the App.
